Eradicating a blind particular person from work merely due to their incapacity is in opposition to the PWD Rights Act 2016

In the recent Suddhasatva Banerjee case against Santanu Mitra, the petitioner had filed a case indicating that a memo had been sent to the petitioner removing the blind petitioner from the post of head of the Bengali department by the Haringhata Mahavidhyalaya .

Under Section 20 of the Act, the government cannot discriminate against a person with a disability in relation to employment.

Taking this provision into account, the Court of Justice overturned the disputed memo and ordered the authorities questioned to take appropriate action because the memo was discriminatory and violated the 2016 Law on the Rights of the PWD
